A contract between you and the owner will occur when payment (full or part) is processed and a booking confirmation is issued showing the confirmed holiday dates. The contract binds you & all the members of your party. You are responsible for ensuring that all party members accept the terms here. Failure to disclose all relevant information or comply with these terms may lead to contract termination, loss of the booking and any monies paid.
Bookings cannot be accepted from persons under eighteen years of age.
The owner reserves the right to refuse a booking without giving any reason.
We, and our representatives, reserve the right to enter the property at any reasonable time to undertake essential maintenance or for inspection purposes.
Tenancies typically commence at 3pm unless otherwise agreed, and guests must vacate the rental by 11am on the day of departure.
Deposits And Balances
A 20% deposit of the total cost is payable at the time of the reservation. Bookings made less than four weeks before the start of the booking must be paid in full. We reserve the right to request a £200 refundable damage deposit after the reservation is made.
Outstanding balances must be paid no later than four weeks before the commencement of your booking. If the balance is not received by the due date, your booking will be treated as a cancellation and deposit forfeited.
All cancellations must be notified by email to firstname.lastname@example.org, quoting your booking ID and reservation dates.
If you cancel your booking within one week of making the reservation, you will receive a full refund minus the prevailing payment process costs, which are typically no more than 5% of the amount paid.
If you cancel your booking more than one week after making the reservation, any monies paid will be forfeited.
We will not cancel your booking except in exceptional circumstances beyond our control. Notification will be given of the cancellation as soon as possible, and we will promptly refund all payments. Our liability for cancellation will be limited to payments made to us.
All payments, deposits and balances will be charged to a credit or debit card by our payment processor, Stripe. We do not handle or see your card details. The card must belong to the person making the booking and registered to their home address. We reserve the right to request additional ID if required.
Once the booking is confirmed, we will send you a payment request from Stripe for the deposit. We will send you another payment request for the balance four weeks before the booking commences. In each instance, you will have three days to settle the payment. If not paid, the booking will be cancelled and refunded per the terms stated here.
Once your deposit is paid, we will ask you to complete a secure online guest information form. This will require the name, address and contact details of all guests along with a photo or scan of their passport.
In line with local regulations, we will hold this data on file for one year. As per Spanish law, this information will be made available to the local police station at the start of the booking.
No Parties Or Events
The maximum number of persons using the accommodation must not exceed four adults. Children are not allowed on the property. Only those listed on the booking form can occupy the property. We reserve the right to terminate the booking without notice or refund in case of a breach of this condition.
No Pets, Smoking Or Vaping
Animals, vaping or smoking anywhere inside the premises, including the terrace, is not permitted and will immediately terminate the reservation and forfeiture of all payments.
Any damage or extra cleaning required due to a violation of this condition will be charged to the person making the booking.
Damages And Breakages
In making a booking, you accept responsibility for any theft, breakage or damage sustained for the duration of the booking. You also agree to indemnify us for any loss we may incur. A security deposit of £200 may be required and will be returned within 14 days of the end of your holiday, less the cost of damage/breakages.
Casa Elana is fitted with aircon in the main bedroom and lounge. As well as providing cooling in the warmer months, it can also supply heating in the cooler months.
With the cost of energy going up, the cost of running aircon is now very expensive. Therefore we ask you to please only use the aircon when it's needed, and never when you leave the house.
Due to the electrical limitations put on all houses in the village, only two of the three units can be used at the same time.
If any keys are not returned at the end of your stay, the replacement cost for locks, keys and fitment will be charged.
Like many village houses in Spain, Casa Elana has some steep and narrow stairs. Therefore it is not suitable for people with limited mobility.
Guests must vacate the house by 11am on the last day of their booking. Please tidy after yourself and deposit all rubbish in the large green bins opposite the house. Please clean the kitchen after yourself. If our cleaner has to wash dirty dishes, cutlery, etc., a charge of €20 will be made.
Please treat the facilities & accommodation with due care so that other guests can continue enjoying them. If you notice something missing or damaged in your accommodation, please let us know immediately so we can take the appropriate action. If there has been any damage or breakages during your stay, please report it promptly.
Please do not move any furniture from one room to another.
Please lock the doors and security gates and close the windows when you leave the property unoccupied.
Please make sure you switch off lights, heating, air conditioning or any electrical appliances (exluding those that must remain on, like fridges etc.) when you go out – we're an eco-friendly holiday home!
Please don't take any bath towels with you to the beach. Use the beach towels (if provided).
The owner reserves the right to make a charge to cover additional cleaning costs if the client leaves the property in an unacceptable condition.
The client may not re-let or sublet the property, even free of charge.
The owner shall not be liable for any temporary defect or malfunction of any equipment, machinery or appliance in the building unless caused by misuse or mistreatment.
No compensation will be given for any temporary outage of electricity, gas, water, internet connection or television service.
The owners are not responsible for the loss of any personal belongings or valuables of the guest.
All inventory must remain in the property and not be taken to another.
Any problem or complaint the client may have concerning their stay must be immediately reported to us, at which point we will endeavour to make matters right. The owner will not consider any complaints not reported at the time and only reported after the client has returned from holiday.
Candles are not allowed inside the house.
We reserve the right to make reasonable amendments or additions to these terms and conditions without notice.
Temporary parking for loading and unloading is available at the side of the house. If you permanently park here, you do so at your own risk of getting a ticket. There is a free car park across the road, 1 min walk from the house.
The owner takes no responsibility for any loss or damage incurred while the car is parked either in the free car park or to the side of the house.
Spanish Life is noisy!
Casa Elana is on the small road that runs through the village, directly opposite the Plaza De La Concordia, in the heart of the village "old town". This is a lively and busy part of Torrox with the usual hustle and bustle of daily Spanish life. The house is a traditional build, with thick walls and good insulation, but you will hear village life when the windows and doors are open, or if things outside get particularly loud. Please consider this when making a booking.
It's generally quiet overnight. However, additional sound insulation methods are available if you are a light sleeper. (Contact us for details).
Respect Your Neighbours
You are staying in a built-up area. Please respect the community and keep noise levels to a minimum, especially between 12 am, and 8 am. No music on the terrace after 11pm. No music inside the house after midnight.
We reserve the right to terminate a booking without compensation where the unreasonable behaviour of guests may impair the enjoyment, comfort, or health of others.
Please use the designated barbecue utensils and clean the Barbecue after use. Although a previous guest may have left some behind at the end of their booking, you will generally need to provide your own BBQ fuel.
